Sad week for CEO of Minds and Machines. M+M is the first - I like to call them - "Multiple Registry" to have generated a serious buzz around new gTLD projects. I have a lot of respect for the work of that person who was among the first of new gTLD applicants to have understood that innovation would make the difference bringing so many new extensions to the market.

Le .Club, un registre victime de son succès

Si le registre .Club excelle dans l’art d’installer ses noms de domaine partout dans le monde, il est aussi aujourd’hui la nouvelle extension Internet la plus contestée.

Il existe un Top 10 des nouvelles extensions Internet les plus enregistrés. Dans l’ordre; l’extension “.club” est en troisième place avec plus de 700 000 noms enregistrés:
  1. .XYZ : 2 336 651
  2. .TOP : 1 130 198
  3. .CLUB (par exemple: www.gtld.club) : 709 794
  4. .WANG : 633 489
  5. .WIN : 618 035
  6. .网址 : 346 286 (“adresse Internet” en Chinois)
  7. .SCIENCE : 341 795
  8. .LINK : 267 681
  9. .REN : 238 491 (veut dire “être humain” en Chinois)
  10. .PARTY : 225 530

Pourtant en troisième place du classement et alors que le volume des enregistrements ne représente que le tiers de celui du .XYZ, c’est bien l’extension .CLUB qui est la plus utilisée à des fins parfois questionnables.

Des noms de domaine squattés
Comme l’indique le Registre lui même, les noms de domaine “.club” sont les nouvelles adresses Internet les plus contestées lors de procédures juridiques de type UDRP et URS.

Pour rappel, une procédure UDRP (Uniform Domain Name Dispute Resolution Policy) est la procédure qui permet de contester l’enregistrement d’un nom de domaine et d’ordonner son transfert à son propriétaire. La procédure URS (Uniform Rapid Suspension System), quant à elle, est une procédure plus rapide, moins coûteuse mais qui ne permet pas d’ordonner le transfert du nom de domaine. On se demande d’ailleurs l’intérêt d’une telle procédure quand on sait que le nom de domaine, pour être récupérable, doit retomber dans le domaine public; laissant ainsi la possibilité à un tiers de l’enregistrer à ce moment là.

Cinquante trois cas de procédures étaient enregistrés pas le NAF, le forum d’arbitrage et de médiation pour les noms de domaine, au 11 février 2016.

Afin de remédier à cette montée en puissance des litiges liés aux noms de domaine “.club”, le Registre a décidé de s’adresser aux Directions Juridiques et Conseils en Propriété Industrielle lors du prochain rendez-vous de l’INTA à Toronto.

C’est paradoxal, mais qu’on le veuille ou non, le nombre de cas de squatting de noms de domaine est aussi un indicateur du succès d’une nouvelle extension Internet.
